We have an update on a story we brought you last fall – detailing the 1987 kidnap, torture, and murder of 23-year-old Marty Etchemendy of Miles City.

You may remember brothers Lester and Vernon Kills On Top were both sentenced to death for the crime, but through a series of appeals over several years, their death sentences were commuted to life in prison. Further appeals to the Montana Supreme Court by Vernon Kills On Top ultimately led to the dismissal of his aggravated kidnapping charge on the grounds of double jeopardy.

That 2019 decision made Vernon eligible for parole, but on Monday we learned that parole date will never happen. Mike Etchemendy, Marty's brother, tells us he was informed Monday morning that Vernon passed away in prison.
