A family in Conroe, Texas, is suing a Texas utility company for gross negligence after their boy died during subfreezing weather this week.
11-year-old Cristian Pineda died after sleeping two nights in an unheated mobile home that lost power during the winter storm.
Investigators say they're still trying to determine how the boy died.
They say a carbon monoxide test in the home was negative.
The family's attorney says they believe a brutally cold night, when temperatures got down near ten-degrees, is to blame.
The lawsuit accuses the Electric Reliability Council of Texas and Entergy, a utility company serving the area, of gross negligence.
The family is seeking 100-million dollars in damages.
In response to the lawsuit, Entergy released a written statement, saying they are deeply saddened by the loss of life in their community, but they are unable to comment due to the pending lawsuit.
