Georgia man claims son was raped at Special K Ranch

The Special K Ranch is being accused of negligence after a Georgia man alleges his developmentally disabled son was raped while at Special K Ranch. 

Mike Oberg, executive director of Special K Ranch, is denying the claims. The claims of the sexual assault were originally raised in 2017 after the man's son stayed at Special K Ranch for a couple of days.

The complaint was filed in U.S. District Court in Billings May 1, 2018. 

According to the complaint, the plaintiff's son is developmentally disabled and is "particularly vulnerable to abuse and neglect." The complaint also said such persons are, statistically, uniquely vulnerable to sexual and physical abuse due to their inability to defend or advocate for themselves. 

The plaintiff said his son is legally incapable of consenting to sexual contact. He said prior to the alleged sexual assault, his son had not been a victim of abuse or neglect. 

The complaint details how the resident acted after one of his visits to the facility. The plaintiff said his son was acting "unusually, being (very) quiet, unwilling to change his clothes or bathe and (isolated) himself." The documents state this behavior was also noticed by his counselor, who suspected he had been sexually assaulted. The resident's mother had him evaluated for sexual assault due to the behavior. 

Based on the sexual assault physical examination, it was determined that he had been raped. 

Oberg told KULR-8 he has never met the plaintiff. He said the complaint came as a shock because the original allegations were brought up in 2017. Oberg does not dispute the evidence that the resident was raped, but said it did not happen at Special K Ranch. He said the sheriff's office conducted an investigation nearly a year ago and could not find evidence of a rape happening at the facility. 

"We gave them all the evidence we had, you know, timecards, timelines, all of that," Oberg said of the investigation. "There's just, like they said, there's just not an opportunity for this to have happened."

Oberg said the resident was only part of their day program and did not stay overnight.

The complaint also alleges Special K Ranch did not notify the resident's guardians and did not seek medical care. 

Oberg said he believes Christian nonprofits are becoming targets for lawsuits. 

"They think you're going to settle, so you don't get it out there because once it's out there, there is a percentage of people that are just going to assume it's true, regardless of the facts," Oberg said Special K Ranch has sent their documents to their legal team and plans to defend the facility if the complaint goes to trial.
