North Dakota high court upholds firm's illegal dumping fine

BISMARCK, N.D. (AP) - North Dakota's Supreme Court has upheld $950,000 in fines against a trucking company accused of illegally dumping saltwater on a Williams County road in 2014.

Wyoming-based Black Hills Trucking Inc. argued it had paid a $200,000 fine to the state Health Department so it should not have to pay another $950,000 to the state Industrial Commission for the same violations.

The court's majority opinion issued Thursday says the Industrial Commission "conclusions are sustained by the law and by substantial and credible evidence."

The company is accused of illegally dumping saltwater near Tioga in February and March 2014. Regulators sought the fines after an inspector witnessed illegal dumping.

The company did not immediately return a telephone call for comment Thursday.
