Man Gets Deliberate Homicide Charge

The man accused of stabbing Billings photographer and philanthropist downtown last Thursday appears in court.

Zachariah Wiseman, 23, is charged with one count of deliberate homicide. Court documents show Wiseman was under the influence of a drug. Last Thursday, around 1:30 PM, police responded to a stabbing on North 24th Street. They found Wiseman being held to the ground by two men, a knife on the floor, and another man, Michael Sample, with stab wounds in his stomach. Sample was taken to the hospital where he later died from his injuries.

Court documents indicate in interviews with witnesses, Sample would often give money to those in need at his photography studio. Witnesses say they saw Sample and Wiseman talking at the back door of the business when Wiseman attacked Sample. In an interview, Wiseman told officers he was asking Sample if he could work for money. He told officers he remembers Sample was inappropriate and then blacked out, later saying, Sample must have fallen on the knife.

In an interview with Wiseman's girlfriend, officers learned Wiseman believed Sample would have a large amount of cash after lunch. She also told officers Wiseman regularly used methamphetamine and was increasingly violent.

An autopsy revealed Sample had been stabbed three times. A forensic pathologist says the likely cause of death was a stab wound in Sample’s heart.
