BILLINGS, Mont. -

The Montana Attorney General's Office on Friday asked the state Supreme Court to stand by it's ruling on Stacey Rambold, the former Billings Senior High Teacher who raped a 14-year-old student.

In April, the state's highest court ordered that Rambold should be re-sentenced after getting an "illegal sentence of 30 days" and that the mandatory minimum was 2 years.

Rambold's attorneys asked for a re-hearing on its ruling and stated Judge G. Todd Baugh had the right to factor in the girl's behavior in handing down the sentence.

Judge Baugh said the girl acted older than her chronological age which sparked outrage in the community along with the sentence.

The Attorney General's office responded to the request for a re-hearing saying no blame can be attached to the girl under state law.
