Griego Trial: Defense Suspect Was In Jail During Several Attacks

Posted: Updated:
BILLINGS -

The third day of the trial of Toby Griego kicked off with a Michael Biggs.

On the date of the first rape in question, Biggs was near the area and was picked up by Billings Police. Biggs found out he was a suspect and said to police, "you got to be joking ... it's not me." Biggs was questioned about the rape and denied it.

The defense has argued there is reasonable doubt because police did pick up another suspect.

Briggs was questioned where he was during the other 3 rapes, and he says he was in jail for the 2nd and 3rd attacks, and was out of the town for the fourth. Briggs says he cooperated with the police at all times.

The defense attorney cross examined Biggs trying to establish he was familiar with police and police procedure and had to cooperate.
