Settlement Reached in Man's Death at City Pool

A settlement is reached in a lawsuit filed over a man's death at Rose Park Pool in 2011.

41-year old Bart Bieber was swimming at Rose Park Pool in July of 2011 when he suffered a heart attack. His wife sued the city claiming lifeguards never called 911 and failed to have an Automated External Defibrillator available.

A judge approved a settlement this week.

The Bieber family was awarded $900,000, a third of that will go towards attorney fees. In the settlement the city agreed to place a defibrillator at Rose Park Pool before the pool opens next summer. Also in the settlement the city did not have to admit liability.
