Custer County leaders want to build a new detention center and could find out tonight if they can go forward with their plan.

Tuesday is the deadline for ballots on a $7.5 million bond to build the new jail.

The ACLU threatened a lawsuit over the lack of fresh air and open spaces in the current facility in miles city.

Law enforcement now must shuttle inmates to other facilities such as Glasgow, three and a half hours away, at a big expense to the taxpayers, roughly a quarter-of-a-million dollars a year.

A spokesperson says if Custer County doesn't get a new detention center, the county could be bankrupt within three years.

Custer County commissioners say they are also concerned about public safety. They, along with the sheriff, tell KULR 8 News some of those in trouble with the law have to be released because there's not enough space, or money, to hold them.

Commissioners don't want to raise taxes but hope people understand the critical need for a new jail.
