A Petition Has Canceled Judge Baugh's Hearing

We have new developments tonight in the case involving Judge G. Todd Baugh.

Judge Baugh canceled the re-sentencing hearing in the Stacey Rambold case after attorney general Tim Fox filed an emergency petition requesting the court stop the hearing.

According to Montana code and a previous setting case, the only way to correct an illegal sentence is to appeal and on Wednesday the state did just that.

But just minutes before the scheduled hearing those lined up waiting for Baugh's doors to open found out the re-sentencing hearing had been canceled.

Judge baugh opened his doors to make a comment on the case and the mandatory minimum sentence error.

The state does not plan to move forward with the appeal and will address the legality of the imposed sentence.
