BILLINGS -

It was February 11th of 2013 when Billings Police Officer Grant Morrison shot and killed 32-year-old Jason Shaw on Custer Avenue.

Tuesday marks the first day of testimony in the coroner's inquest investigating whether the shooting was legal. Sergeant Shawn Finnegan testifies in the early morning hours on February 11th he and Officer Grant Morrison approached a vehicle with four people in it on Custer Avenue. Video surveillance taken from officer Morrison's patrol car shows officer Morrison issuing commands to Shaw, who appears to refuse to cooperate. Surveillance goes on to show Morrison attempting to taser Shaw, with testimony indicating Shaw began to reach for what looked like a firearm, which was later discovered to be a BB gun replica of a P-99 handgun. Officer Morrison then shot Shaw one time. Shaw later died from the wound to his stomach.

Other detectives testified officers had been watching the home on Custer for drug trafficking activity in the past. The pathologist testified Shaw had an extremely large dose of methamphetamine in his system. The doctor said that would explain Shaw's aggressive and uncooperative behavior.

The inquest will resume Wednesday at 9 AM. Officer Grant Morrison is expected to testify.
