Wyoming Supreme Court upholds sentence in DUI fatal

CHEYENNE, WYOMING - The Wyoming Supreme Court has upheld a lengthy prison sentence for a man convicted of aggravated vehicular homicide.

The Supreme Court on Thursday upheld a district judge's sentence of from 36 to 40 years in prison for Maurice C. Noller of Wamsutter. Prosecutors say Noller was drunk when he collided head-on with another vehicle in January 2008 near Gillette. The crash killed 51-year-old Jonni Kay Brown of Weston. Brown's daughter, Rori Coates, and 3-year-old grandson, Joby Coates, were injured.

Noller had pleaded guilty to aggravated vehicular homicide and two counts of DUI causing serious bodily injury. In his appeal, Noller argued that the sentencing judge should not have considered a pre-sentence report.
