Supreme Court reverses sex case convictions

CHEYENNE, WYOMING - The Wyoming Supreme Court has reversed a 23-year-old Cheyenne man's child sexual assault convictions.

The high court on Tuesday reversed the convictions of Johnn Thomas Woyak. A Cheyenne jury in January 2009 convicted Woyak of three counts of sexual assault and two counts of sexual exploitation of a child. He received a prison sentence of up to 58 years.

Four Supreme Court justices ruled that a Cheyenne district judge violated Woyak's rights by refusing to allow him to attend a court hearing on whether a boy was competent to testify against him.

Justice E. James Burke filed a dissenting opinion, saying Woyak's convictions should stand. Cheyenne District Attorney Scott Homar says his office intends to prosecute Woyak again.
