Judge dismisses complaint against UW

LARAMIE, WYOMING - A judge has dismissed a lawsuit filed against the University of Wyoming by a former maintenance employee over his firing.

State District Judge Jeffrey Donnell granted the dismissal on Jan. 27. David Morse had filed a complaint against UW, saying he was discriminated against. He also contended that he was exposed to asbestos in facilities he was assigned to clean. He says he notified supervisors and asked for protective gear, but nothing was done.

Although Donnell granted the motion to dismiss, he said Morse still has time to file a claim under the Wyoming Governmental Claims Act. Morse was hired full-time in August 2008 and fired last March. His termination letter listed the cause as poor performance, insubordination and failure to follow instructions.
