Duncan wants to act as own attorney

BOISE, Idaho - Joseph Duncan the Third is asking a federal judge in Idaho for permission to act as his own attorney during the sentencing phase of his death penalty case.

Duncan faces the death penalty for kidnapping and torturing Dylan and Shasta Groene in May 2005, and the murder of Dylan at a remote campsite in western Montana. Duncan pleaded guilty in December to 10 federal charges, three of which qualify for the death penalty.

U.S. District Judge Edward Lodge says he'll consider Duncan's request during a hearing Friday. Lodge delayed the subject Wednesday, to avoid inconveniencing dozens of potential jurors scheduled to undergo questioning in the case this week.
