Dillon couple can use medical marijuana while case prosecuted

DILLON - A judge says a Dillon couple, charged after a marijuana bust at their home, will be allowed to continue using the drug for medicinal purposes while they're awaiting trial.

Prosecutors allege that Scott Day and Summer Sutton-Day were growing 96 marijuana plants to deal the drug. They asked the court to deny the couple any access to marijuana. But District Judge Loren Tucker says a doctor approved their use of marijuana to help alleviate pain from a variety of ailments; and the judge says that justifies their continued use.

Day is 34, and Sutton-Day is 29. They face felony charges of production, possession and intent to distribute dangerous drugs. The couple's home north of Dillon was raided February 1st.
