Pretrial motions denied in Barkus case

KALISPELL, Mont. (AP) — A judge has denied several motions filed by a Kalispell state senator charged in a Flathead Lake boat crash that left U.S. Rep. Denny Rehberg's state director in a coma for more than a week.

District Judge John McKeon of Malta ruled Aug. 26 that an attorney for Sen. Greg Barkus did not offer any evidence to support requests for suppression of evidence, a change of venue or the dismissal of all charges.

The Daily Inter Lake reports that jury selection is scheduled to begin Nov. 29. Barkus is charged with criminal endangerment and two counts of negligent vehicular assault for the August 2009 crash into the rocky shoreline.

Flathead County prosecutors allege Barkus had a blood-alcohol level of 0.16 nearly two hours after the crash. Rehberg, his chief of staff, Barkus and his wife were also injured.
