BILLINGS - The bench trial began Monday for a driver accused of running over and killing a woman who fell off her motorcycle.

James Hagberg is also accused of fleeing the scene and trying to cover up the crime. He pleaded 'not guilty' to the charges more than a year ago.

Monday, District Court Judge Ingrid Gustafson heard testimony from witnesses and medical personnel. Prosecutors said Hagberg struck Renae Merkel on May 3rd, 2008, after she'd fallen off her motorcycle in Huntley.

The Defense is arguing the woman was already dead when he struck her. Investigators said Hagberg fled the scene and wiped off the hood of his car before contacting law enforcement.

No word on how long the trial is expected to last.
