BILLINGS - A Billings woman will serve no jail time for her role in the death of a 3-year-old back in 2004.

In a plea deal, an emotional Jennifer Larson was sentenced to 10-years to the Montana Women's Prison with all time suspended for one count of criminal endangerment. Judges have determined Jennifer Larson, Thomas Larson, and Jessica Thompson all contributed to the death of Thompson's 3-year-old son Lupe Mulipola.

In 2004, prosecutors say Thomas Larson slammed shook Lupe and slammed the boy's head into the ground. Lupe's mother failed to seek medical attention in a timely fashion and Lupe died days later.

Prosecutors say Jennifer Larson did not physically injury the toddler, but was still responsible for not providing care or seeking medical help after the incident.

Thomas Larson is serving 40 years in prison with 10 suspended for the crime. Jessica Thompson is serving 15 years with seven suspended for her role in her own son's death.
