BILLINGS - A Billings man hopes to have his medical marijuana shop open in Billings in just over a month.

Even though Montana voters approved an Intiative in 2004 making the drug legal for qualifying patients, Mark Higgins is still in violation of federal laws. However federal officials have generally taken the stance of leaving the issue up to states.

Mark Higgins is a medical marijuana user. And his user card allows him to have 6 plants and 1 ounce of dried marijuana on hand at all times. And since he's also a provider, he can also have that much for each patient he serves.

"Hearing stories of patients makes me sad, it brings tears to my eyes. They're living lives of misery and they're hanging on the hope that their doctor will prescribe something that will give them relief."

There are already providers in Billings, but so far they only operate out of their homes. Higgins would have the first business and store. "I think it's time to have that discussion," says property owner Dennis Pitman.

Pitman was unsure at first about renting the space to Higgins, but he's done his research and is currently drawing up a lease. Pitman says he's not too concerned about anything illegal going on in the location, since the store is in a very visible spot.

"Being on Main Street keeps it in the public view, we can keep close tabs on it." Higgins however is concerned about security issues and the reaction he will get from the community.

"I am concerned about what the community is going to think but I feel strongly enough about medical marijuana that I'm willing to stick my neck out." Higgins says it's worth it to bring the medical marijuana business out of the shadows and into a store front, so legal users aren't made to feel like criminals looking for their next high.

I us the VA for my medical care. It is rediculous that I have to contact them every month for my pain meds but it takes three months for an appointment. If you call them you will often spend over half hour on hold. Way to take care of our verterans. I would like to stop taking 40mg celexa and 6 percocet a day. I would rather smoke pot and live to be an old man. Unfortunately my work has a policy against marijuana. I sit at a desk all day. I am not driving or using any machinary.

A person who is drunk can get in a barfight, kill someone with his car after he leaves the bar and go home to beat his wife and kids into a coma and barely get punished under current laws. A pothead smokes a joint, eats some twinkies and watches cartoon network for a few hours. Which is the worst drug here? And this is for medical marijuania, not the public. Theres a large number of the population on prescription narcotics and some of them are a danger to themselves and the community.

If Medical Cannabis is cooked in honey, then consumed with a hot drink, there is not even any ill side effects of smoking. I wonder how many dopers walk around in the public eye now??? I like that we do not have to sneak and hide. I LIKE not hurting every day. A cup of tea takes care of the hurt mentally and physcially. Thank you God for Cannabis.

Just like usual we get the knee-jerk comments like what was made at the start of the comments section, but it's great that not only is there going to be a place where those that ARE MEDICALLY PERMITTED can get their supply but also that the land owner is willing to open his mind and his building, kudos to the building owner and Mr. Higgins.

I think this is a wonderful alternative to addictive drugs. Notice I said "addictive", not "habit-forming". Anything can become a habit and generally this habit is not going to harm anyone. People who may have given up hope can have a natural alternative to the endless parade of drugs and by the way - MJ DOES work to relieve pain and I can't think of any reason why it was placed on earth except as medicine. If an aloe vera plant got you high, it would be banned too....

Kudos to Billings for shaking off the propaganda of the past! Cannabis is truly a miracle medicine that all Humans have the right to. The mere notion of Politicians being the gatekeepers of our Health is ridiculous - if a Dr. feels that Cannabis - instead of a myriad of prescription narcotics with sometimes deadly side-effects - is the best thing for their patient, people should have it available to them. In the history of mankind Cannabis has never killed anyone, it is a safer choice for many.
