BILLINGS - A man who admitted his part in the shaking death of a 3-year-old Billings child appears in court Thursday.

Court officials say they expected Thomas Larson to be sentenced Thursday, but scheduling problems with witnesses have pushed it back. "For my grandson, he will never comeback no matter so why should they live free in this life if Lupe don't comeback," Masina Ava.

In front of family and friends Larson sat shackled listening to Masina Ava recount the day in September 2004 when she heard her grandson, 3-year-old Lupe Mulipola had been severely injured, Lupe later died. Larson has already pleaded guilty to negligent homicide. Prosecutors say Larson killed Lupe by picking him up by his ankles shaking him and slamming his head into the floor. But, the court had problems trying to reach a child abuse expert and had to postpone Larson's sentencing.

Wednesday Lupe's mother Jessica Thompson was sentenced to 15 years in prison with seven suspended for negligent homicide for her role in the child's death.
