Laurel Officer Takes Stand

BILLINGS - Local law enforcement took the stand Friday in Justice Court before court officials considered a motion to dismiss a misdemeanor DUI charge.

The case involves Laurel Police Officer David Firebaugh who shot through the window of car at Jonas Torres. The shooting occurred on November 1, 2007. Firebaugh took the stand after nine Friday morning.

During that time deputy county attorney asked the Officer Firebaugh what happened when he encountered Torres out of his vehicle. "Do you remember what he was telling you from the video tape," said the prosecutor. "Just shoot me," said Officer Firebaugh. "So was he taunting or challenging you, did you take that as a challenge," the prosecutor asked. "I believe so, yes," said Firebaugh.

Court officials say officer Firebaugh tasered Torres before taking him into custody. Torres has been charged with several criminal charges.
